On Friday, June 13th 2008, Officer Nate Holmes pulled over Mr. Roderick Wilde, an every day motorized foot scooter rider, for driving without a helmet. Mr. Wilde stated that helmets are not required for riding a Motorized Foot Scooter. Officer Holmes argued that the scooter has a saddle and is therefore not a motorized foot scooter. Mr. Holmes wasn't aware that Motorized Foot Scooter RCW 46.04.336 states "... is designed to be stood or sat upon by the operator..." Is Mr. Holmes insisting on Mr. Wilde to hurt himself by riding on a seat post? It's possible that Mr. Holmes, out of frustration of being wrong, quickly made up his own law, as there is no reference of saddle mentioned in any Motorized Foot Scooter code. Mr. Wilde asked for his card, and though there was no ticket issued for this non-existent law, it was still wrong of Mr. Holmes to make up his own law and falsely detain Mr. Wilde for his legal activity.
